Services Provided

ShanWebDesign offers the following services:

  • Website audits and reviews to assess performance, security, and usability.
  • Setup and configuration of web hosting accounts, email accounts, and domain registrations (note: ShanWebDesign is not itself a hosting provider but will arrange and configure third-party hosting services for your site).
  • Additional services on request, such as search engine optimization (SEO), copywriting, photography, graphic design, digital marketing, and consulting.

All services will be described in the project proposal or agreement that we provide to you. We will perform the services with reasonable skill and care.

Client Responsibilities

To complete your project successfully, you must:

  • Provide timely feedback, approvals, and decisions when requested.
  • Supply all required content (such as text, images, videos, or logos) needed for the project by agreed deadlines.
  • Respond to our communications and requests promptly.
  • Review deliverables (e.g., website drafts) and inform us of any changes or corrections as soon as possible.
  • Ensure that you have the rights to use any content you provide (ShanWebDesign will assume you have permission to use all text and images you supply and will not be liable for any copyright issues arising from them).

Delays caused by the client (such as late feedback or content delivery) may affect the project timeline.

Payment Terms

  • A 50% deposit is required before any work begins.
  • Any remaining fees will be divided into stage payments or a final payment as agreed in the project proposal.
  • Full payment must be made before the final handover of the project deliverables.
  • For business clients, any balance is due within 3 working days of project completion.
  • Late payments will incur interest at 8% above the Bank of England base rate (per annum) from the due date until payment is received.
  • Invoices are payable in GBP and exclude VAT (if applicable), which will be added at the current rate for taxable services.
  • Payment is typically made via bank transfer. (Bank details will be provided on the invoice. ShanWebDesign does not store your bank details after processing a payment or refund.)

Project Timeline

  • We will provide an estimated timeline or completion date for your project.
  • All dates are estimates and not guaranteed. Timelines may change due to unforeseen circumstances or technical issues.
  • If you delay in providing content, feedback, or approvals, we may adjust the schedule accordingly. We will inform you if such delays extend the timeline.

Intellectual Property

  • ShanWebDesign retains all intellectual property rights in the design, code, graphics, and other work produced until you have paid in full.
  • Upon full payment, we grant you a non-exclusive licence to use the completed deliverables for your business.
  • If you require full ownership of all intellectual property (including source files, graphics, or bespoke code) beyond this licence, a separate agreement and fee will be required.
  • You retain ownership of any content (such as text or images) you provide to us.
  • Unless you ask us otherwise, we may display your completed project (including your business name and website) in our portfolio, on our website, or in marketing materials.

Refunds and Cancellations

  • We do not generally offer refunds except as required by the UK Consumer Rights Act 2015.
  • You have the right to cancel within 7 days of our starting work on the project. If you cancel within this period, a cancellation fee of 25% of the total project cost will apply.
  • If you cancel after work has begun (but within 7 days), you must pay for the work already completed at the agreed rate plus the cancellation fee.
  • After 7 days from the start of work, no refunds are available, and all fees are payable in full.
  • Any deposit paid will be credited against any cancellation fees or work already done.

Liability

  • ShanWebDesign will perform services with reasonable skill and care. However, we do not guarantee error-free work or that your website will always be available.
  • We are not liable for any indirect losses (such as lost profit or business opportunity) resulting from our services.
  • We are not responsible for failures or performance issues of third-party services (such as web hosts, payment gateways, or internet outages).
  • We are not responsible for missed deadlines or defects caused by client delays or for any work requested outside the original scope without a new agreement.

Third-Party Collaborators

  • We may work with subcontractors or freelance collaborators (for example, copywriters, photographers, or designers) to deliver certain services.
  • All third-party collaborators are required to maintain confidentiality. ShanWebDesign remains responsible for the quality and completion of the project.
  • You will always have ShanWebDesign as your main point of contact, even if others are involved in the work.

Dispute Resolution and Governing Law

  • We will try to resolve any disputes informally by discussion.
  • If a solution cannot be found amicably, we may agree to mediation or another form of Alternative Dispute Resolution.
  • If disputes still cannot be resolved, legal action may be taken in the courts of England and Wales.
  • These Terms of Service are governed by the laws of England and Wales.

All content on the ShanWebDesign website — including but not limited to text, images, graphics, logos, icons, layout, design elements, and code — is the intellectual property of ShanWebDesign unless otherwise stated, or unless it is a display of another company for example in the portfolio there may be work or assets etc. not created by ShanWebdesign.
